1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of AttendMe's AI-powered medical research assistant service ("Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
To use AttendMe, you must:
- Be at least 18 years old
- Be a healthcare professional, medical student, or researcher
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Service under applicable laws
3. Account Registration
You agree to:
- Provide accurate, current, and complete registration information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Service Description
AttendMe provides an AI-powered research assistant that helps healthcare professionals find and analyze medical literature. The Service includes:
- AI-assisted search of medical literature
- Citation management and library features
- Query history and saved searches
- Various subscription tiers with different features
4.1 Global Regulatory Classification
Australia (TGA)
AttendMe is designed for clinician review of literature, guidelines, and protocols. It must not be used to process medical images, waveforms, monitoring signals, or patient identifiers. Australian medical-device and CDSS obligations must be reassessed before any feature is supplied for patient-specific diagnosis, monitoring, triage, treatment selection, or non-reviewable AI outputs.
New Zealand (Medsafe)
AttendMe is intended as an information and research-support tool for healthcare professionals. If a New Zealand deployment or marketing claim gives the service a therapeutic purpose as a medical device, the supplier must assess the Medicines Act and WAND notification obligations before supply.
United States (FDA)
AttendMe is intended to support healthcare professionals by showing citation-backed medical information and the basis for outputs. It is not intended to acquire or analyze medical images, IVD data, or device signals, or to provide time-critical, non-reviewable, or autonomous outputs. Any US use case outside that boundary requires reassessment under FDA digital-health policy.
Common Intended-Use Boundary: In all jurisdictions, AttendMe is offered only within this boundary:
- Professional Use Only: The Service provides evidence-based information to healthcare professionals, medical students, and researchers, not to patients
- Does Not Replace Clinical Judgment: All outputs are recommendations and synthesized literature analysis that must be verified by the healthcare professional using independent judgment
- Information Can Be Verified: All responses include full citations to peer-reviewed medical literature, enabling independent verification against primary sources
- Supports, Not Directs: The Service augments clinical decision-making but does not make autonomous clinical decisions
Healthcare Professional Acknowledgment: By using AttendMe, you acknowledge that you retain full responsibility for all clinical decisions. You must use only de-identified clinical scenarios and must not submit patient names, dates of birth, contact details, addresses, medical record numbers, insurance identifiers, or other patient-identifiable information.
5. Acceptable Use Policy
You agree NOT to:
- Use the Service for direct patient care or medical decision-making without professional judgment
- Input any patient-identifiable information or Protected Health Information (PHI)
- Share your account credentials with others
- Use the Service for any illegal or unauthorized purpose
- Attempt to reverse engineer, decompile, or hack the Service
- Scrape, data mine, or use automated systems to access the Service
- Violate any applicable laws, regulations, or third-party rights
- Transmit viruses, malware, or other harmful code
- Interfere with or disrupt the Service or its servers
- Circumvent usage limits or access restrictions
6. Intellectual Property
Our Property
AttendMe and its licensors retain all rights to the Service, including all software, content, designs, and trademarks. You may not copy, modify, distribute, or create derivative works without our written permission.
Your Content
You retain ownership of your queries and saved content. By using the Service, you grant us a license to process and display your content as necessary to provide the Service.
Third-Party Content
Medical literature and citations accessed through the Service remain the property of their respective publishers and authors. Your use of such content is subject to applicable copyright laws and publisher terms.
7. Fees and Payment
Paid subscriptions are billed according to the plan you select:
- Subscription fees are paid in advance
- All fees are non-refundable except as required by law
- We may change fees with 30 days' notice
- You're responsible for all applicable taxes
- Failed payments may result in service suspension
8. Cancellation and Termination
By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Extended period of inactivity
9. Disclaimers and Limitations
We specifically disclaim:
- The accuracy, reliability, or completeness of any information
- The Service will meet your requirements or be error-free
- Any implied warranties of merchantability or fitness
- The suitability of information for medical decision-making
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTENDME SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Medical malpractice or patient harm
- Errors or omissions in the Service
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless AttendMe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your professional medical practice or decisions
12. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting your privacy and maintaining appropriate data security measures.
13. Modifications to Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice for material changes that adversely affect your use of the Service.
14. Governing Law and Disputes
These Terms are governed by the laws of Australia (specifically New South Wales), without regard to conflict of law principles. AttendMe Pty Ltd is an Australian company subject to Australian regulatory frameworks including the Therapeutic Goods Administration (TGA) for medical device classification. Any disputes shall be resolved through binding arbitration in Sydney, Australia, except for claims seeking injunctive relief.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and AttendMe
- Severability: If any provision is found invalid, the remainder shall continue in effect
- Waiver: Our failure to enforce any provision is not a waiver of our rights
- Assignment: You may not assign these Terms without our written consent
- Updates: We may update these Terms with notice to you
